Terms of Service - Chicken Road

1. Introduction

Welcome to Chicken Road. These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile application, website, and services (collectively, the "Service"). By downloading, installing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Chicken Road is owned and operated by Chicken Road Studios, Inc. ("we," "us," or "our"). We reserve the right to modify these Terms at any time. We will provide notice of any material changes through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. User Accounts

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use a strong, unique password and to sign out from your account at the end of each session.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Content

Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media formats and through any media channels for the purpose of providing and promoting the Service. This license terminates when you delete your User Content or your account.

You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

5. Prohibited Uses

You agree not to use the Service for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Service.

Prohibited activities include, but are not limited to:

Using the Service for any illegal purpose or in violation of any local, state, national, or international law
Harassing, threatening, or intimidating other users
Posting or transmitting any content that is abusive, harmful, obscene, or otherwise objectionable
Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity
Interfering with or disrupting the Service or servers or networks connected to the Service
Attempting to gain unauthorized access to parts of the Service, other accounts, computer systems, or networks connected to the Service
Using any robot, spider, crawler, scraper, or other automated means to access the Service for any purpose

6. In-App Purchases and Subscriptions

The Service may offer the opportunity to purchase virtual items, currency, or premium features ("In-App Purchases") or to subscribe to premium content or features ("Subscriptions"). In-App Purchases and Subscriptions are governed by these Terms as well as the terms of the applicable app store (such as Apple App Store or Google Play Store).

All purchases are final and non-refundable, except as required by applicable law. We reserve the right to modify, terminate, or otherwise amend our offered In-App Purchases and Subscriptions at any time.

You acknowledge that:

You are solely responsible for all In-App Purchases and Subscriptions made through your account
We are not responsible for addressing any claims you have relating to In-App Purchases or Subscriptions
Prices for In-App Purchases and Subscriptions may change at any time without notice

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Chicken Road Studios, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Chicken Road Studios, Inc.

8. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by Chicken Road Studios, Inc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings available in the Service.

10. Limitation of Liability

In no event shall Chicken Road Studios, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Chicken Road Studios, Inc., its subsidiaries, affiliates, and licensors do not warrant that (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date at the top of these Terms. You are advised to review these Terms periodically for any changes.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
